Abstract:
The public’s right to environmental information on industrial hazards, exercised through various channels including digital communications, is a complex and evolving legal construct. This right involves not only access to information but also participation in decision-making, and its exercise depends on multiple factors, including legal frameworks and institutional practices. This thesis examines the evolution of these components through a theoretical and legal analysis focused on the creation and application of law. Particular attention is given to the role of the judiciary in enforcing access to public information, facilitating public participation, and accommodating the diversity of exercise modes. Observed discrepancies in the application of these rights reveal the adaptability of the public right to environmental information in practice, reflecting its purpose and implementation rather than an intrinsic evolution of the right itself.
